Working in cooperation with the Turkish Informatics Foundation (TIF) in the framework of the Informatics and Telecommunication Working Group set up under the aegis of the TÜSİAD Technology, Innovation and Information Society Committee, a report was prepared entitled “Assesments on the Ban of Internet Websites in Turkey from Different Legal Aspects”. The study, commenting on the conformity of restrictions to internet access in Turkey by legal decisions with fundamental legal principles, was presented to the public at a seminar on 4th March 2011.
The opening speeches at the seminar were given by TÜSİAD President Ümit Boyner and TIF President Faruk Eczacıbaşı. Ümit Boyner stated that it was unacceptable that whenever “internet censorship” is mentioned, the name of Turkey is recalled amongst the ranks of certain undemocratic countries. Stating that there were certain limits and rules restricting rights and freedoms, Boyner said that these were based on the use of one person’s rights not harming the rights of others, and the need not to damage individual benefits in society. Maintaining the integrity of the essence of these rights is an important principle. Restrictions may be enforced only in conformity to the democratic order of society and above all they must be measured.
The report examines the basic legal principles that should be applied in taking judicial decisions on internet access. From this standpoint the report aims to draw attention to the evaluation of potential violations in decisions on restricting access by judicial authorities as a scientific source. The report also examines internet access restriction from the perspective of freedom of thought and expression.
